Terms of Service - Legacy Masterpieces

By placing an order with Legacy Masterpieces, you agree to the following terms and conditions:
1. Customer Responsibility for Uploaded Content
When you upload photos, images, or any other content to create a customized product, you represent and warrant that:
- You own all rights to the uploaded images OR have obtained explicit permission from the copyright holder to use them for commercial printing purposes
- The images do not infringe on any third party's intellectual property rights, including but not limited to copyrights, trademarks, publicity rights, or privacy rights
- You have obtained all necessary permissions, releases, and consents from any individuals depicted in the photos
- The images do not contain any illegal, defamatory, or obscene content
2. Prohibited Content
You may NOT upload:
- Professional photographs without the photographer's written permission
- Images of celebrities, professional athletes, or public figures without proper licensing
- Copyrighted logos, team names, or league trademarks (NFL, NBA, MLB, NHL, NCAA, etc.) unless you have obtained proper licensing
- Stock photos or images downloaded from the internet without proper licensing
- Any content that violates local, state, or federal laws
3. Indemnification
You agree to indemnify, defend, and hold harmless Legacy Masterpieces, its owners, employees, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your uploaded content
- Your violation of these Terms of Service
- Your violation of any third party's rights, including intellectual property rights or privacy rights
- Any claim that your uploaded content caused damage to a third party
4. No Affiliation with Professional Organizations
Legacy Masterpieces is NOT affiliated with, endorsed by, or sponsored by any professional sports leagues, teams, organizations, or governing bodies. We create custom, faith-based sports memorabilia cards for personal use only. Any team names, logos, or trademarks uploaded by customers are the property of their respective owners.
5. Right to Refuse Service
Legacy Masterpieces reserves the right to refuse or cancel any order that we believe, in our sole discretion, violates these terms or infringes on third-party rights. We may request proof of rights or permissions before fulfilling orders.
6. Processing Time and Shipping
All products are custom-made to order. Current processing time is approximately 2 weeks for production and shipping. Processing times may vary based on order volume.
7. No Warranty on Customer Content
Legacy Masterpieces is not responsible for verifying the authenticity, ownership, or legality of customer-uploaded content. We act solely as a printing service for content provided by customers. Customers bear full responsibility for ensuring their uploaded content is legal and properly licensed.
8. Limitation of Liability
Legacy Masterpieces shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or products, including but not limited to claims related to customer-uploaded content.
9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the State where Legacy Masterpieces operates, without regard to conflict of law principles.
10. Changes to Terms
Legacy Masterpieces reserves the right to modify these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the modified terms.
